Agreement - Nordic Art Guide
When you reserve a spot in Nordic Art Guide you agree to the following terms in the legally binding agreement below:
AGREEMENT – PARTICIPATION IN WORLD ART GUIDE
This is an agreement between the individual or company that has completed the above application form, hereinafter referred to as "The Artist," and Bellamonti Art, hereinafter referred to as "Bellamonti Art," for The Artist's participation in The Nordic Art Guide, hereinafter referred to as "The Art Guide."
1. The Artist must submit an English presentation text of his/her artistry, approximately 230 +/- 20 words for "Bronze" or "Silver" options, and approximately 320 +/- 20 words for the "Gold" option. If The Artist has selected the "Premium" option, a presentation text of approximately 320 words must be submitted. The Artist should also provide a maximum of five art merits for the CV (if available), information about the artwork's media, size, year of creation, and title, a link to the artist's website (if available), email address, and Instagram account name (if available). The name of The Artist is always written in full or with the last name only in their biography. Bellamonti Art has the right to edit and shorten the submitted presentation text without prior notification to The Artist. Bellamonti Art assures that the editing will not include condescending or offensive content, such as personal attacks or criticism of The Artist.
2. Bellamonti Art determines the design and layout of The Art Guide. The Artist cannot influence this, as Bellamonti Art strives for a cohesive and aesthetically pleasing representation of participating artists.
3. Bellamonti Art has the right to sell The Art Guide for any amount through selected channels, including but not limited to the internet, distributors, digital and physical events, booksellers, and libraries in all countries worldwide. This includes using The Artist's presentation image, images of artwork, and presentation text from January 1, 2025, to December 31, 2035, without providing any compensation to The Artist. After this deadline, Bellamonti Art has the right to give away the book free of charge to interested clients, without compensating The Artist. Bellamonti Art also has the right to use The Artist's name, images of artwork, and submitted material for marketing purposes, including but not limited to the internet, newspapers, and media. The same applies if The Artist has been chosen to provide the cover their artwork.
4. The Artist retains ownership rights to the submitted artwork and other materials provided to Bellamonti Art.
5. By signing this agreement, The Artist acknowledges that the participation fee must be paid to the specified account on the upcoming invoice, or directly with a credit/debit card, or with the chosen external payment option such as f.ex Klarna. If the payment is not made in full, the matter will be referred to collections, and if necessary, to the bailiff until the full payment and associated fees are settled. In such cases, The Artist forfeits the right to participate in The Art Guide. Please note that The Artist cannot withdraw the application form since The Art Guide is a custom-made product containing text and photos submitted by The Artist, and Bellamonti Art begins the editing and participation process immediately. Even if The Artist chooses not to participate in The Art Guide, the fee for the selected exposure level must still be paid.
6. The Artist understands that submitted photographs of artwork must be of high quality, with a minimum size and resolution of 2500 x 2500 pixels, to be eligible for inclusion in The Art Guide. The images must also have a professional feel. If The Artist fails to meet Bellamonti Art's quality requirements, Bellamonti Art has the right to reject the participation without providing a refund. Bellamonti Art can offer advice to facilitate this process and avoid disagreements. The Artist can also contact Bellamonti Art before signing this agreement to ensure that the image quality meets the requirements.
7. Artwork must be photographed in its original form. Paintings and photographs should not be framed or displayed in an environment, although sculptures and designs are exempt from this rule.
8. The Artist assumes responsibility for complying with copyright regulations and agrees not to use copied or copyrighted works as image materials in The Art Guide. This includes, but is not limited to, using Disney characters, Marvel characters, other artists' works, or photographs owned by another person and subject to copyright, such as images of famous individuals. Bellamonti Art has the right to refuse participation without providing a refund if The Artist fails to meet this requirement. If Bellamonti Art publishes such works regardless, The Artist will be liable in a lawsuit if the copyright holder takes legal action, and Bellamonti Art and/or The Art Guide will not be held responsible
9. The Artist acknowledges that Bellamonti Art reserves the right to print The Art Guide in two separate parts for practical reasons, should the need arise.
10. Bellamonti Art commits to printing a minimum of 100 (one hundred) copies and a maximum of 10,000 (ten thousand) copies of The Art Guide. Bellamonti Art undertakes to make The Art Guide available for free to approx 100 art galleries, art museums, art collectors, and other individuals and entities in the art industry, for three years from the published date. The individual or entity must apply through e-mail to request The Art Guide and pass the approval process. Bellamonti Art can't promise that The Art Guide will be delivered to 100 art galleries, art museums, art collectors, and other individuals and entities in the art industry, but will make The Art Guide as available as possible.
11. Bellamonti Art promises to send mandatory copies of The Art Guide to selected libraries in compliance with Swedish laws.
12. If the number of participating artists is fewer than 65 (sixty-five), Bellamonti Art may choose to provide The Artist with a full refund before December 31, 2028, after deducting any bank and transaction fees associated with the payment and refund process. In such cases, the agreement will terminate immediately upon Bellamonti Art's notification via email. If Bellamonti Art decides to print The Art Guide despite having fewer than 65 participating artists, no refund will be provided, and The Artist will participate in The Art Guide as agreed until the specified end date.
13. If The Artist has selected the "Premium" or "Platinum" category, the availability of a "Premium" or "Platinum" service cannot be guaranteed until payment has been made to Bellamonti Art. Bellamonti Art recommends making this payment within two working days. If another artist pays for the "Premium" or "Platinum" option before The Artist, the fee will be returned to The Artist, minus any transaction fees, and The Artist can choose another exposure level in The Art Guide.
14. The Artist understands that Bellamonti Art is obligated to add a 25% VAT according to Swedish tax laws and a 6% VAT for books if The Artist has not provided a valid European VAT ID number or proof of business in English (if located outside the European region). The Artist cannot add a VAT ID number or proof of business after submitting this application form. If The Artist resides in Sweden, VAT will always be added to the invoice.
15. Bellamonti Art has the right to refuse to accept The Artist without any explanation. If this situation occurs, The Artist will be informed and a refund will be made to The Artist.
By purchasing a spot in The Art Guide, the agreement automatically becomes legally binding.
